Settlement Information
A proposed settlement has been reached in the class action lawsuit titled, In re: Cleveland Brothers Data Incident Litigation., No. 1:23-cv-00501 (the “Lawsuit”). The Lawsuit asserts claims against Defendant Cleveland Brothers Equipment Company, Inc (“Defendant” or “Cleveland Brothers”) related to a data breach discovered on November 3, 2022, about which Defendant notified potentially impacted individuals on or about February 17, 2023 (the “Data Breach”). Defendant denies all claims asserted in the Lawsuit and denies that it did anything wrong.
Who is in the Settlement Class?
You are in the “Settlement Class” if your personally identifiable information (“PII”) was exposed to unauthorized third parties as a result of the data breach discovered on November 3, 2022.

You may exclude yourself from this Settlement and keep your right to sue separately. If you exclude yourself, you will receive no payment. Refer to FAQ 16 for detailed instructions on how to exclude yourself from the Settlement. |
Object to the Settlementby June 24, 2024 |
If you do not exclude yourself, you may write to the Court to comment on or detail why you do not like the Settlement. The Court may reject your objection. You must still file a claim if you desire any monetary relief under the Settlement. Refer to FAQ 19 for detailed instructions on how to object from the Settlement. |
